TERMS AND CONDITIONS OF SALE & WEBSITE USE

These Terms and Conditions (“Terms”) govern access to and use of the GeekParts website (“www.geekparts.com.au”) and the purchase of products from GeekParts (“we”, “us”, “our”). By accessing this Website or placing an order, you agree to be legally bound by these Terms.

If you do not agree, you must not use this Website.

1. BUSINESS DETAILS

GeekParts is an independent supplier of replacement laptop and mobile phone parts and accessories in Australia.

2. DEFINITIONS

  • ACL means the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

  • Goods means products supplied by GeekParts.

  • Customer means any person or entity purchasing Goods from us.

  • Order means a request submitted by the Customer to purchase Goods.

3. ACCEPTANCE OF ORDERS

3.1 All Orders are subject to acceptance by GeekParts.
3.2 We reserve the right to refuse, cancel, or limit any Order at our sole discretion, including where:

  • Goods are unavailable

  • Pricing errors have occurred

  • Fraud or unauthorised activity is suspected

3.3 A binding contract is formed only when we confirm dispatch of the Goods.

4. PRICING & PAYMENT

4.1 All prices are in Australian Dollars (AUD) and include GST where applicable.
4.2 We reserve the right to vary prices at any time prior to Order acceptance.
4.3 If a pricing error occurs, we may cancel the Order and provide a refund.
4.4 Full payment must be received prior to dispatch.

5. PRODUCT INFORMATION & COMPATIBILITY

5.1 Customers are solely responsible for verifying compatibility of Goods prior to purchase.
5.2 Product descriptions, images, and specifications are provided for general guidance only.
5.3 Minor variations in colour, design, or specification may occur.

GeekParts accepts no liability for incorrect purchases resulting from Customer error in identifying model numbers, part numbers, or compatibility requirements.

6. SHIPPING & RISK

6.1 Delivery timeframes are estimates only and not guaranteed.
6.2 Risk in the Goods passes to the Customer upon dispatch.
6.3 GeekParts is not liable for delays, loss, or damage caused by third-party carriers.

Where insurance is required, it is the Customer’s responsibility to request it prior to dispatch.

7. RETURNS & AUSTRALIAN CONSUMER LAW

7.1 Nothing in these Terms excludes, restricts, or modifies any rights under the ACL.

Under the ACL, customers are entitled to remedies if Goods:

  • Are faulty or defective

  • Are not of acceptable quality

  • Are not fit for purpose

  • Do not match the description

7.2 Where a major failure occurs, the Customer may choose a refund or replacement.
7.3 For minor failures, we may elect to repair or replace the Goods.

7.4 Change of Mind Returns

Change-of-mind returns may be accepted at our discretion subject to:

  • Request within 14 days of delivery

  • Goods unused, uninstalled, and in original packaging

  • No physical damage

  • Proof of purchase provided

We reserve the right to:

  • Charge a restocking fee

  • Refuse returns that do not meet these conditions

  • Deduct original shipping costs from refunds

Installed, used, or electrically connected components are strictly non-returnable unless faulty under ACL.

8. WARRANTY

8.1 Goods may include a limited warranty period as specified on the product page.
8.2 Warranty claims must be supported by proof of purchase.

The warranty does not cover:

  • Physical damage

  • Improper installation

  • Liquid damage

  • Electrical surge damage

  • Misuse, neglect, or modification

  • Damage caused during installation

  • Removal of warranty labels or tampering

Warranty is void where Goods show signs of attempted repair or alteration.

9. INSTALLATION & LIABILITY DISCLAIMER

9.1 GeekParts supplies parts only and does not provide installation services through this Website.
9.2 Installation of electronic components involves inherent risk.
9.3 The Customer assumes full responsibility for installation.
9.4 GeekParts shall not be liable for:

  • Damage to devices during installation

  • Loss of data

  • Loss of business or income

  • Consequential or indirect loss

Professional installation by a qualified technician is strongly recommended.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

10.1 GeekParts’ total liability for any claim relating to the supply of Goods shall not exceed the purchase price paid.
10.2 We are not liable for indirect, incidental, special, punitive, or consequential damages.
10.3 We are not liable for loss of profits, revenue, goodwill, or data.

This clause survives termination of these Terms.

11. INTELLECTUAL PROPERTY & TRADEMARK DISCLAIMER

All trademarks, brand names, product names, and logos are the property of their respective owners.

GeekParts is not affiliated with, authorised by, or endorsed by:

  • Apple Inc.

  • HP Inc.

  • Dell Technologies

  • Lenovo

  • ASUS

Brand names are used strictly for identification and compatibility purposes.

All Website content, including text, images, graphics, and layout, is the intellectual property of GeekParts and may not be reproduced without written consent.

12. WEBSITE USE

You must not:

  • Use the Website for unlawful purposes

  • Interfere with security features

  • Upload malicious code

  • Copy or scrape content without permission

We reserve the right to suspend or terminate access without notice.

13. INDEMNITY

The Customer agrees to indemnify and hold harmless GeekParts against any claims, damages, losses, liabilities, costs, and expenses arising from:

  • Improper installation

  • Misuse of Goods

  • Breach of these Terms

14. GOVERNING LAW

These Terms are governed by the laws of Queensland, Australia.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.

15. AMENDMENTS

We reserve the right to amend these Terms at any time. Updated Terms will be effective upon publication on the Website.

Continued use of the Website constitutes acceptance of any revised Terms.
